Privacy Policy

AfterHours AI ("we," "our," or "us") operates the AfterHours Answer service at afterhoursanswer.com. This Privacy Policy explains how we collect, use, and protect information when you use our AI-powered answering service.

By using our service, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

From Callers

When a caller contacts a business using our service, our AI assistant may collect:

  • Caller name — provided by the caller during the conversation
  • Phone number — from inbound caller ID or provided by the caller
  • Service address — provided by the caller for service dispatch purposes
  • Service request details — description of the caller's needs, urgency level, and any relevant details
  • Call recordings — audio recordings of calls handled by our AI assistant
  • Call transcripts — text transcriptions of conversations

From Business Clients

When you sign up as a business client, we collect:

  • Business name and contact information
  • Owner name, email address, and phone number
  • Business services offered and service area
  • Billing information (processed by Stripe — we do not store card numbers)
  • Account credentials (password stored as a one-way hash)

Automatically Collected

  • Server logs (IP addresses, timestamps, request paths)
  • Session tokens stored in browser local storage

2. Call Recording Disclosure

⚠️ Important: Calls handled by our AI answering service may be recorded and transcribed for quality assurance and lead capture purposes. Our AI assistant discloses this at the start of each call.

Call recordings and transcripts are used to:

  • Provide lead capture reports to the subscribing business
  • Improve the accuracy and quality of our AI service
  • Resolve disputes or complaints

Two-Party Consent States

Some U.S. states (including California) require that all parties to a phone call consent to being recorded. Our AI assistant provides a verbal disclosure at the beginning of each call. By continuing the call after this disclosure, the caller consents to recording. Business clients are responsible for ensuring their use of our service complies with applicable state and local recording laws.

3. TCPA Compliance

Our service is designed to receive inbound calls only. We do not initiate outbound calls to consumers on behalf of business clients. Business clients are solely responsible for ensuring any outbound follow-up communications they conduct comply with the Telephone Consumer Protection Act (TCPA) and applicable regulations.

4. How We Use Information

  • Lead capture — Caller information is delivered to the subscribing business as lead data
  • Service operation — To route calls, generate transcripts, and deliver summaries
  • Service improvement — Anonymized data may be used to train and improve our AI models
  • Billing — To process subscription payments and manage accounts
  • Communications — To send account alerts, trial status updates, and service notices

5. Data Retention

  • Call recordings: Retained for 90 days, then automatically deleted
  • Call transcripts and lead data: Retained for the duration of the client's active subscription plus 30 days after cancellation
  • Account data: Retained for 30 days after account deletion, then permanently purged
  • Server logs: Retained for 30 days

6. Third-Party Services

We use the following third-party services to operate AfterHours AI. Each service has its own privacy policy:

  • Twilio — Phone number provisioning and call handling (twilio.com/legal/privacy)
  • Vapi — AI voice call infrastructure (vapi.ai/privacy)
  • ElevenLabs — AI voice synthesis (elevenlabs.io/privacy)
  • Stripe — Payment processing (stripe.com/privacy)
  • Anthropic / Claude — AI conversation model (anthropic.com/privacy)

We share only the minimum data necessary with each provider to operate the service.

7. Data Sharing

We do not sell personal data to third parties. We may share information in the following limited circumstances:

  • With the subscribing business — caller information is the core deliverable of our service
  • With service providers — as described in Section 6 above
  • Legal requirements — if required by law, court order, or to protect our legal rights
  • Business transfer — in connection with a merger, acquisition, or sale of assets (with notice)

8. Cookies and Tracking

We use minimal cookies and browser storage:

  • Authentication token — stored in browser localStorage to keep you logged in to the dashboard
  • No advertising cookies, no cross-site tracking, no analytics pixels

9. Data Security

We implement appropriate technical and organizational measures to protect your data, including encrypted connections (HTTPS/TLS), hashed passwords, and access controls. However, no method of transmission or storage is 100% secure.

10. Your Rights and Data Deletion

You have the right to:

  • Request access to data we hold about you
  • Request correction of inaccurate data
  • Request deletion of your data (subject to retention requirements)
  • Opt out of non-essential communications

Note: Callers who wish to have their information removed from a business's lead records should contact that business directly. We will process deletion requests we receive and pass them to the relevant client where applicable.

11. Children's Privacy

Our service is not directed to individuals under 18 years of age. We do not knowingly collect personal information from children.

12. SMS/Text Messaging

AfterHours AI sends SMS text messages to business owners who use our AI answering service and to callers who reach those businesses.

Who Receives Messages:

  • Business Owners (Clients): Receive SMS notifications when their AI answering service captures a new lead, including caller name, phone number, and issue description. Message frequency varies based on after-hours call volume (typically up to 50 messages per month).
  • Callers: Receive a one-time SMS confirmation that their after-hours message was received and forwarded to the business.

Phone Number Collection & Usage: We collect phone numbers from business owners during account sign-up at afterhoursanswer.com/signup.html. Callers' phone numbers are captured via caller ID when they call our AI answering service. All phone numbers are used solely for delivering SMS notifications related to the AfterHours AI service.

Third-Party Sharing: We do not sell, rent, loan, or share any phone numbers with third parties for their own marketing purposes. SMS messages are delivered through our telecommunications provider, Twilio Inc., which processes messages on our behalf under a data processing agreement.

Express Consent (Opt-In): Business owners provide express written consent during sign-up by checking a required checkbox on our registration form stating: "I agree to receive SMS notifications about new leads and emergency alerts. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out at any time." with links to this Privacy Policy and our Terms of Service.

Opt-Out: Reply STOP, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, or STOPALL to any message to unsubscribe. Reply HELP for assistance or contact hello@afterhoursanswer.com. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Data Rights: You may request access to, correction of, or deletion of your phone number and associated SMS data at any time by emailing hello@afterhoursanswer.com. We will respond within 30 days.

Children's Privacy: This SMS service is not directed to individuals under 18.
